Welcome to [Mobile] (hereinafter referred to as “the App” or “we”). This User Agreement (“Agreement”) sets out the terms and conditions under which you (the “User” or “You”) will use this App by [Horizonpay Nigeria Limited] (“we” or “us” or “the Company”). Rights and obligations to be complied with when using the services provided by this application. Please read and understand the following terms and conditions carefully, and your download, installation, registration, login, and use of the Application and its services shall be deemed that you have fully understood and agreed to accept all the contents of this Agreement.
- Service Description
1.1 This app provides you with financial services such as digital currency investment and trading, virtual asset management, mobile payment, money transfer and remittance, bill inquiries, balance recharge and withdrawal, etc. (specific functions are subject to the actual in-app display). The scope of services may be adjusted in accordance with legal and regulatory requirements and business development.
1.2 For users who apply for the transfer and payment service through the Mobile application, you will be randomly assigned a virtual account number that has been linked to your Mobile account.
- Account Registration and Management
2.1 You must be at least 18 years of age to access or use the Services or create a Mobile account, as the Services are not intended for children under the age of 18. The Services do not apply to any user who has previously been removed from the Services by Mobile (or whose user account has been terminated). You represent and warrant that you have the legal right and ability to access and use the Services in accordance with these Terms;
2.2 Provide all information requested by us, such as your name, gender, date of birth, email address, passport photo, address, cell phone number, bank verification number (“BVN”), online credentials for registering with Mobile, and such other information as we may request from time to time (collectively, the “User Information“); by providing your BVN, you authorize Mobile to collect and store your data from the BVN database as our know-your-customer (”KYC”) information to meet regulatory requirements. All KYC data collected will be treated as confidential. You also give us permission to use your BVN to monitor, prevent and detect fraudulent activity and to share it with CBN’s authorized stakeholders to prevent financial fraud;
2.3 Ensure that all User Information provided to us is true, accurate, current and complete and agree not to misrepresent your identity or your User Information. You agree to notify us of changes to your User Information in a timely manner. If we approve your registration, you will be authorized to use the Services, subject to these Terms, and the Services may not be used for fraudulent activities;
2.4 Users are responsible for maintaining the confidentiality of their accounts and passwords, are responsible for all activities that occur under their accounts, and Mobile will not be liable for the operation of any third party unless mutually agreed upon in writing. Any unauthorized use or other breach of security shall be notified to the Application immediately;
2.3 In accordance with Nigerian anti-money laundering and counter-terrorism financing related regulations, users are required to complete the real name authentication process by submitting the necessary identification documents to verify their identity. Failure or refusal of real name authentication may result in some or all of the service features being restricted;
- Use of the Service
3.1 The User undertakes to comply with Nigerian and international laws and regulations when using the services of the Application and shall not use the Services for money laundering, terrorist financing, tax evasion, fraud, gambling, drug trafficking, infringement of intellectual property rights or other illegal activities.
3.2 The User shall comply with the rules set by the Application in terms of transaction limits, frequency and categories. We have the right to take measures such as restricting, suspending or terminating the service for abnormal transaction behavior.
3.3 The use of the services of this application may involve fees such as crediting fees, withdrawal fees, transfer fees, etc. The specific charges are subject to the public announcement within this application.
- Use of Information
4.1 Provision of Payment Services
Use your information to process payment transactions, including initiating payment requests, verifying payment passwords, completing the payment process, processing refunds and inquiring about the status of transactions, etc., to ensure the accuracy and timeliness of payments. Recommend convenient payment methods or related financial products and services (e.g., payment promotions, wealth management services, etc.) for you based on your payment history and preferences.
4.2 Security and Risk Control
Monitor and prevent payment fraud, money laundering, brush theft and other illegal activities by analyzing your transaction patterns, device information and identity verification data to safeguard your account and funds.
When abnormal transactions or security risks are found, we will notify you in time and take corresponding measures, such as suspending the payment function and requesting re-verification of identity.
4.3 Optimization of User Experience
Based on your usage habits and feedback, we will improve the interface design, functional layout and operation flow of the APP to enhance the ease of use and stability of the APP.
Conduct data analysis and market research to understand user needs and payment market trends in order to develop new functions and services.
- Privacy and Data Protection
5.1 Mobile respects and is committed to protecting your privacy. You understand that by accessing or using the Services and/or submitting your User Information through the Services, you consent to the collection, use, storage and disclosure of your User Information in accordance with our Privacy and Cookie Policy. Please review the full Privacy and Cookie Policy on our website.
5.2 Users agree to receive service-related notifications, marketing messages and other communications from the Application.
5.3 We will revise and improve the Privacy Policy in a timely manner in accordance with changes in laws and regulations, business development, and technological updates. When there are significant changes to the Privacy Policy, we will post a notice in a prominent position within the APP to inform you of the changes and the effective date. Your continued use of the APP after the update means that you accept the updated Privacy Policy.
- Disclaimer and Limitation of Liability
6.1 Although we will endeavor to maintain the continuity and stability of the service, the app is not responsible for any interruption or delay in service due to network failure, system maintenance, force majeure and other factors.
6.2 Digital currency investment is subject to multiple risks such as price fluctuations, technical risks, and policy risks. Users should fully understand and bear all risks and losses arising from investment decisions.
6.3 We care about the integrity and security of your user information. We have implemented commercially reasonable technical and organizational measures designed to protect your User Information from accidental loss and unauthorized access, use, alteration or disclosure. However, you acknowledge and agree that, despite our reasonable security measures, we cannot guarantee that electronic communications over the Internet will be 100% secure and that unauthorized third parties will never be able to defeat these measures or use your User Information for improper purposes. You acknowledge that you are under no obligation to use the Services and that you provide any personal or sensitive information in order to use the Services at your own risk!
- Changes and Termination of the Agreement
7.1 We reserve the right to modify the Agreement at any time, and the revised Agreement will be announced in the application or notified to the User by email or other means. If the user continues to use the service, he/she is deemed to have accepted the revised agreement.
7.2 Users have the right to cancel their accounts at any time, and after cancellation, we will handle user data in accordance with laws and regulations. Before canceling your account, please make sure that you have properly disposed of the funds, assets and debt relationships in your account.
- Service Termination
8.1 The Application has the right to suspend or terminate the provision of services to the user under the following circumstances: (1) the user violates the Agreement; (2) the requirements of laws and regulations or the instructions of regulatory agencies; (3) to protect the security of the user’s account or the normal operation of the Application.

9.1 These Terms are made under and will be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to any principles of the laws of other jurisdictions that may apply.
9.2 If you have any dispute about this Privacy Policy or our handling of your personal information, you should first attempt to resolve it with us through amicable negotiation. If the negotiation fails, the dispute may be resolved through legal means in accordance with relevant laws and regulations. The dispute resolution process does not affect the parties to continue to fulfill the other non-controversial terms of this Privacy Policy.
