Payment & Service Delivery

Payment for services is required upfront. We may change our service charges, but we’ll always inform you before you make a payment. ELIGIBILITY

TRANSACTION MANAGEMENT, CANCELLATION, AND REFUNDS

Transaction Cancellation: Transactions on Confidcard.com may be canceled if a request is made within a specific time window, which is determined by
Confidcard.com based on the transaction’s status and processing stage. You
understand and agree that Confidcard.com has the sole discretion to determine whether a transaction can be canceled.

Confidcard.com may also cancel any transaction if it’s deemed suspicious, falls outside our risk parameters, or if you fail to provide all necessary information (such as a purchase receipt) to verify the authenticity and legality of your transaction.

Transaction Modification: Confidcard.com may modify a transaction if it was
submitted with incorrect details. By using Confidcard.com, you agree that we ma modify your transaction in our best interest to ensure accuracy and service integrity. Our quality assurance policies are designed to ensure your satisfaction as a user.

Refunds: For transactions that are successfully canceled by Confidcard.com, are fund will be processed. All refunds are subject to Confidcard.com final discretion and may be subject to deductions for direct costs and any applicable handling fees incurred before cancellation. Refunds will only be issued if the service (e.g., giftcard exchange) has not yet been completed.

Anti-Money Laundering Policy

Money laundering has been a major instrument through which major atrocities

In complying with the extant money-laundering laws and regulations, and

a) Created a compliance unit that is headed by a compliance officer who

DISCLOSURE OF INFORMATION
All private information shall be governed by the Privacy Policy on the Website. The Company does not sell, rent or lease its customer list to third parties. Unless the Company receives notice from the Client to the contrary, the Company shall from time to time provide to the Client (by post, telephone or email) such information in relation to the Services that the Company considers may be of interest to the Client.

AMENDMENTS

The Company may update or modify this Agreement from time to time. If the

Company modifies the Agreement during the Services, the modified version will take effect upon the next Service. Client may be required to check the update version from time to time after the modified version takes effect, in any event the continued use of the Services shall constitute acceptance of the modified version.

SEVERABILITY

If any provision of this Agreement is found by any Court of competent jurisdiction to be unenforceable or invalid, that provision will be limited to the minimum extent necessary so that this Agreement may otherwise remain in effect.

FORCE MAJEURE

Neither Party will be liable for any delay or failure to perform its obligations under the Agreement (except payment obligations) if the delay or failure is due to causes beyond its reasonable control, such as a strike, blockade, war, act of terrorism, riot, natural disaster, failure or reduction of power or telecommunications or data networks or services, or government act.

SUBPOENAS

Nothing in the Agreement prevents the Company from disclosing Client
information and data to the extent required by law, subpoenas, or court orders,but the Company will use commercially reasonable efforts to notify Client where permitted to do so.

ASSIGNMENT

The Agreement will bind and inure to the benefit of each Party’s permitted
successors and assigns. Neither Party may assign the Agreement without the
advance written consent of the other party, except that the Company may assign the Agreement without consent to an affiliate or in connection with a merger, reorganization, acquisition or other transfer of all or substantially all of its assets or voting securities.

ENTIRE AGREEMENT

The Agreement represents the parties’ complete and exclusive understanding
relating to the Agreement’s subject matter. It supersedes all prior or
contemporaneous oral communications, proposals and representations with
respect to the Company or any other subject matter covered by this Agreement.

INCORPORATION

The Agreement, shall unless otherwise suggested, incorporate all terms and
conditions contained and set out in the Privacy Policy and other written
documents deemed appropriate by the Company including, without limitations,the contents on the Website.

GOVERNING LAWS, JURISDICTION AND VENUE

This Agreement is governed by the laws of Nigeria, without regard to choice or conflict of law rules thereof.

However, other individuals may attempt to launder money in order to conceal their identity or finance their operations. ‘Suspicious activity’ is a very difficult concept to define because it can vary from one transaction to another based upon all the circumstances surrounding the transaction or group of transactions. For example, transactions by one customer may be normal based on our knowledge of that customer and their pattern of activity, while similar transactions by another customer may be suspicious. Many factors are involved in determining whether transactions are suspicious including the amount, the nature of the transaction and frequency of deposits/withdrawals from the system.


Confidcard is committed to fighting money laundering and complying fully with anti-money laundering laws in Nigeria. We understand that we have responsibilities to help fight the global battle against money laundering and our commitment will supersede all other privacy
obligations contained in our policies. Accordingly, Confidcard will take all reasonable and appropriate steps to prevent persons engaged in money laundering, fraud, or other financial crimes from utilizing our products and services.

If your region allows minors to use it with the consent of their guardians, you (or your guardian) must abide by the local laws and regulations on the protection of minors, and this platform does not provide targeted advertising, inducement to pay or other services to minors.

1.2 The following users are prohibited from using this platform:

Users who have been blacklisted or have their services restricted by this platform;

Users whose services have been terminated by the platform due to fraud, violations, or breaches of this agreement;

Individuals or entities subject to international sanctions, judicial injunctions, or legal restrictions;

2. Account registration and management

Your account data (such as transaction records and personal information) will be deleted or anonymized in accordance with this agreement and the privacy policy;

The platform may retain necessary data to fulfill legal obligations (such as taxation and compliance audits), and the retention period shall be subject to relevant legal requirements;

For the unfinished transactions that have been generated, you still need to fulfill your relevant obligations.

3. Transaction rules for gift cards

3.1 Transaction process:

The seller guarantees that the gift cards sold are legal and valid, with compliant sources, and that the provided information such as card number, face value, expiration date, and usage restrictions is true and accurate. If the gift cards are found to be fraudulent, invalid, or have other issues, the seller shall bear the responsibility for refunds, compensation, and other related obligations.

Buyers are required to complete payment through the designated method on the platform within [15] minutes after the order is generated. Orders that remain unpaid after the timeout will be automatically cancelled.

After the transaction is completed, the platform will send a transaction confirmation notification to both the buyer and the seller. Relevant information about the gift card (such as the card number) will only be displayed to both parties involved in the transaction (in accordance with privacy protection requirements).

3.2 Transaction restrictions:

The platform reserves the right to conduct risk reviews on transactions involving large amounts, frequent transactions, and transactions initiated by abnormal IPs/devices. If necessary, transactions may be suspended or restricted to prevent risks such as fraud and money laundering.

The following gift cards are prohibited for trading:

Those with unclear sources, suspected of theft, fraud, or obtained through unauthorized transactions;

Violating the terms of the card issuer (such as non-resale and restricted use to specific regions);

Expired, used, or invalid;

Used for illegal purposes or in violation of this agreement, laws, and regulations.

3.3 Dispute resolution:

When disputes arise between trading parties, they should first attempt to negotiate on their own; if negotiation fails, they may apply to the platform for mediation.

The platform will make an impartial mediation suggestion based on transaction records and evidence provided by both parties (such as proof of gift card validity and communication records). If one party does not accept the mediation result, they can seek legal resolution, and the platform will not bear the responsibility of the final judgment.

If it is confirmed that the seller has provided a fraudulent gift card, the platform will support the buyer in obtaining a refund and take measures such as account restrictions and fines against the seller; if it is confirmed that the buyer has made a malicious complaint, the platform will reject the application and, if necessary, restrict the buyer’s account.

4. Fees and Payment

4.1 The platform may charge transaction fees, withdrawal fees, etc. The specific standards are subject to the information displayed on the page.

4.2 You need to use the payment methods supported by the platform (such as credit card, PayPal, etc.) and bear any potential third-party fees (such as exchange rate differences, bank charges)..

Refund rules: Follow the rules of this platform, and the specific refund process shall be subject to the instructions within the App; for refund requests due to the user’s own reasons (such as wrong purchase, regretting the transaction), the platform has the right to decide whether to support it based on the actual situation.

Using technical means such as web crawlers, automated scripts, and bots to scrape platform data, inflate volume, place malicious orders, or interfere with the normal operation of the platform;

Violating the intellectual property rights (such as embezzling the trademark of the card issuer, images/text content of others), privacy rights, property rights, and other legitimate rights and interests of others;

Bypass platform rules or technical restrictions, engage in private transactions, evade fees, or commit fraudulent acts;

Uploading and spreading illegal, vulgar, violent, hateful, and other inappropriate information;

Other behaviors that violate this agreement or Google Play developer policies.

6. Platform Rights and Disclaimer

6.1 Platform Rights:

We reserve the right to review user accounts, transaction behaviors, and posted content. For users who violate this agreement or laws and regulations, we may take measures such as issuing warnings, restricting functions, suspending accounts, terminating services, etc., without prior notice.

We reserve the right to adjust the service content, functional modules, or operational strategies based on business development. Prior to any adjustments, we will notify users through in-app announcements or other means.

We reserve the right to modify the terms of this agreement. Once modified, the “Last Updated” date will be updated, and users will be notified [30] days in advance. If users do not agree with the modifications, they may cancel their account. Continued use of the service will be deemed as acceptance of the modified agreement.

6.2 Disclaimer:

The platform has established a transaction risk control mechanism, but it does not provide absolute guarantees regarding the ultimate usability and validity of gift cards (such as unavailability due to system failures of the card issuer or theft and unauthorized use of gift cards by third parties). Users should verify the information of gift cards on their own and bear the transaction risks.

The platform shall not be liable for service interruptions, transaction failures, or losses caused by force majeure events (such as natural disasters, wars, policy changes), third-party service failures (such as network operator failures), or user’s own equipment/network issues.

The platform only provides transaction intermediary services and does not guarantee the performance ability and credit status of buyers and sellers. Users should assess the transaction risks on their own, and the platform does not bear any direct or indirect losses caused by the breach of contract by buyers and sellers.

7. Intellectual property rights

7.1 All content on the platform (including but not limited to trademarks, logos, interface designs, source codes, text descriptions, images, and algorithms) belongs to the platform or its authorized parties and is protected by relevant intellectual property laws and regulations. Without written permission from the platform, users are not allowed to copy, modify, disseminate, commercially use, or reverse engineer the aforementioned content.

7.2 User-uploaded content (such as comments, images, transaction evaluations, etc.):

The user guarantees that they possess the legitimate rights to the content and have not infringed upon the intellectual property rights, privacy rights, or any other rights of third parties;

Grant the platform a non-exclusive, worldwide, free usage right (including but not limited to display, storage, and dissemination) for platform operation and service optimization, with no additional compensation required from the platform;

If a third party complains that the content uploaded by a user infringes upon their rights, the platform has the right to remove the content and restrict the user’s account functions according to the situation.

8. Limitation of liability

8.1 The platform shall not be liable for indirect losses (such as loss of profits, data loss, and loss of business opportunities).

8.2 Private transactions between users (transactions not completed through the platform) are unrelated to the platform, and the platform bears no responsibility. If disputes or losses arise, they shall be resolved by the users themselves.

8.3 If the platform incurs losses (such as fines and litigation costs) due to the user’s violation of this agreement or laws and regulations, the user shall fully compensate the platform for the losses.

9. Termination of the agreement

9.1 You may stop using the platform services at any time, or cancel your account through the method stipulated in Article 2.3 of this agreement. Upon account cancellation, this agreement shall terminate (but the provisions involving legal liability, dispute resolution, and intellectual property rights shall remain valid).

9.2 If you violate this Agreement, laws and regulations, or Google Play policies, the platform reserves the right to immediately terminate this Agreement, suspend or cancel your account, and will not refund any fees already collected. Additionally, the platform retains the right to pursue legal action against you.

9.3 The platform may terminate services due to business adjustments, operational difficulties, or other reasons. Prior to termination, users will be notified [30] days in advance, and assistance will be provided to users in handling unfinished transactions, withdrawals, and other matters.

10. Dispute Resolution and Applicable Law

1.1 This app provides you with financial services such as digital currency investment and trading, virtual asset management, mobile payment, money transfer and remittance, bill inquiries, balance recharge and withdrawal, etc. (specific functions are subject to the actual in-app display). The scope of services may be adjusted in accordance with legal and regulatory requirements and business development.

1.2 For users who apply for the transfer and payment service through the Mobile application, you will be randomly assigned a virtual account number that has been linked to your Mobile account. 

  1. Account Registration and Management

2.1 You must be at least 18 years of age to access or use the Services or create a Mobile account, as the Services are not intended for children under the age of 18. The Services do not apply to any user who has previously been removed from the Services by Mobile (or whose user account has been terminated). You represent and warrant that you have the legal right and ability to access and use the Services in accordance with these Terms;

2.2 Provide all information requested by us, such as your name, gender, date of birth, email address, passport photo, address, cell phone number, bank verification number (“BVN”), online credentials for registering with Mobile, and such other information as we may request from time to time (collectively, the “User Information“); by providing your BVN, you authorize Mobile to collect and store your data from the BVN database as our know-your-customer (”KYC”) information to meet regulatory requirements. All KYC data collected will be treated as confidential. You also give us permission to use your BVN to monitor, prevent and detect fraudulent activity and to share it with CBN’s authorized stakeholders to prevent financial fraud;

2.3 Ensure that all User Information provided to us is true, accurate, current and complete and agree not to misrepresent your identity or your User Information. You agree to notify us of changes to your User Information in a timely manner. If we approve your registration, you will be authorized to use the Services, subject to these Terms, and the Services may not be used for fraudulent activities;

2.4 Users are responsible for maintaining the confidentiality of their accounts and passwords, are responsible for all activities that occur under their accounts, and Mobile will not be liable for the operation of any third party unless mutually agreed upon in writing. Any unauthorized use or other breach of security shall be notified to the Application immediately;

2.3 In accordance with Nigerian anti-money laundering and counter-terrorism financing related regulations, users are required to complete the real name authentication process by submitting the necessary identification documents to verify their identity. Failure or refusal of real name authentication may result in some or all of the service features being restricted;
